Auckland CBD height limits could be scrapped

The Government has proposed sweeping changes to planning rules in Auckland's city centre, including the removal of height limits across most of the area. This initiative, announced jointly by Minister for RMA Reform Chris Bishop, Minister for Auckland Simon Watts, and Auckland Mayor Wayne Brown, aims to maximise the benefits of the newly opened $5.5 billion City Rail Link. Current rules cap building heights in various parts of the city centre at 35 to 72.5 metres. While protections for viewshafts, heritage sites, and sunlight controls would remain, the proposal seeks to remove restrictions on maximum tower dimensions, boundary setbacks, and separation standards.

This proposal represents a massive potential shift for property developers and investors in Auckland. A government-commissioned report suggests these changes could unlock capacity for 17,000 more dwellings and 20.3 million square metres of floor space. However, as industry experts point out, this regulatory easing must be matched by efficient consenting processes and robust infrastructure to translate zoning permissions into actual construction. Public consultation on the proposed changes is open until October 16, 2026.

Development contributions strengthened to recover Fast-track infrastructure costs

The Government has announced amendments to the Local Government (System Improvements) Amendment Bill to ensure local councils can recover growth-related infrastructure costs linked to projects approved under the Fast-track regime. Previously, development contributions were locked in based on district plans, creating a potential shortfall when fast-tracked, out-of-sequence developments occurred. The changes will allow councils to amend their development contribution policies without the usual consultation process to specifically target these fast-track developments.

For the property and development sector, this means increased financial certainty for local governments but potentially higher upfront costs for developers utilizing the Fast-track process. Councils must adopt any targeted policy amendments within six months of a project's Fast-track approval. These changes apply to all new Fast-track projects but will not affect those that have already received a draft decision or approval. This interim measure is designed to bridge the gap until the new Development Levies system is introduced in 2029 under the Going for Housing Growth programme.

Public Works Act overhaul complete to drive infrastructure growth

The Public Works Amendment Bill has passed its third reading in Parliament, marking a significant modernisation of land acquisition processes for public infrastructure projects. The updated legislation is designed to reduce delays and uncertainty by streamlining objections and creating a faster emergency-recovery process. It also enables coordinated land acquisition for connected infrastructure projects.

A key feature of the amended Act is the introduction of financial incentives to encourage smoother transactions. Landowners may now receive a 10% incentive payment for agreeing to sell early, in addition to increased disruption payments. For developers and infrastructure providers, this overhaul promises a more efficient, predictable, and potentially faster pipeline for securing the land necessary for critical national and regional projects, while balancing the rights and compensation of affected landowners.
